Short answer: An EIN identifies the business. An ITIN identifies an individual who has a US federal tax purpose but isn't eligible for a Social Security number. Every foreign-owned US LLC needs an EIN, but many single-member LLC owners never need an ITIN. You need one mainly when you personally must file a US tax return or claim treaty benefits.

One more EIN point: the IRS states that you never have to pay a fee for an EIN. Anyone who charges you is charging for their time.
When a non-US LLC owner needs only an EIN
If you own a single-member LLC, the IRS treats it by default as a disregarded entity. That means it isn't taxed separately from you unless it elects to be treated as a corporation. Even so, a foreign-owned single-member LLC still needs an EIN. The Form SS-4 instructions include a specific entry for a "Foreign-owned U.S. disregarded entity-Form 5472", because that LLC must file Form 5472 with a pro forma Form 1120 each year.
You can get that EIN without an SSN or ITIN. The IRS's online application needs one of those numbers, but international applicants can apply by phone, fax or mail using Form SS-4. On line 7b, a responsible party who doesn't have and isn't eligible for an SSN or ITIN enters "foreign" or N/A.
Tax practitioners who work with foreign founders reach the same practical conclusion. Caldwell Tax Services, for example, puts it this way: every foreign-owned US LLC needs an EIN, but the owner personally needs an ITIN only when they must file their own US tax return. Many owners whose LLC does not create a personal US filing obligation never need one.
When you do need an ITIN
The IRS describes an ITIN as a 9-digit number for people who need a US taxpayer identification number for federal tax purposes but aren't eligible for an SSN. It is not a general ID. The IRS also says it does not give you immigration status, work authorization or identification outside the federal tax system.
Personal US tax return (e.g. Form 1040-NR)
The IRS says a nonresident alien who is engaged, or considered to be engaged, in a trade or business in the US during the year must file Form 1040-NR. So must a nonresident with US income whose tax was not fully covered by withholding. If your LLC's activity puts you in that position, you need a taxpayer ID on the return, and that usually means an ITIN. Whether your LLC's activity counts as a US trade or business is a question for your tax adviser.
Claiming tax-treaty benefits
Form W-7 has a separate reason box for a "nonresident alien required to get an ITIN to claim tax treaty benefit". If your adviser recommends claiming a treaty benefit, an ITIN may be part of that process.
When a bank, payout or verification workflow asks for a personal US tax ID
Some banks, payment providers and verification workflows ask the owner for a personal US tax ID. Policies differ by provider and change often. An ITIN may help in those cases, but no one can promise that a particular provider will accept your application. Check the provider's current requirements first. How the ITIN application works
The IRS process, as described on irs.gov and in the Form W-7 instructions:
- Complete Form W-7 and choose the reason you need the ITIN.
- Attach your federal tax return. A new ITIN application is normally attached to the front of the tax return it is needed for, and filed by that return's due date. Some exceptions apply, such as certain treaty claims. If you use an exception, you send the documents that support it instead.
- Prove identity and foreign status. A valid passport is a stand-alone document. Without one, you need at least two documents from the IRS list. You must send originals or certified copies from the issuing agency.
- Choose a route. You can mail the package to the IRS ITIN Operation in Austin, Texas. You can apply in person at certain IRS Taxpayer Assistance Centers by appointment. You can also use an IRS Acceptance Agent, or a Certifying Acceptance Agent (CAA). A CAA can verify your original passport and return it to you immediately, so you don't have to mail it to the IRS. The IRS approves acceptance agents both in the US and abroad.
- Wait for the IRS. The IRS says to allow 7 weeks, or 9 to 11 weeks during tax season or if you apply from overseas.
Each package must include the return or exception documents and acceptable identity documents. Tax practitioners also note that applications without a genuine US filing purpose are typically rejected. Settle the "do I need it?" question first.
Keep your records consistent
This part is ECOMHUTSY's practice, not an IRS rule. When we prepare an ITIN application for an LLC owner, we check that these records tell the same story:
- the name on your passport;
- the LLC ownership recorded in your formation and operating documents;
- the EIN confirmation letter (CP 575) the IRS issued to the LLC;
- the Articles of Organization filed with the state.
A spelling difference, a missing middle name or an outdated address can cause delays with banks and marketplaces. It can also cause awkward questions when your adviser prepares the return. Fixing it before you file is far easier than explaining it afterwards.

Do I need an ITIN to sell on Amazon US?
